Sales made on www.locooshop.com are exclusively reserved for natural and legal persons who hold an email address and a delivery address in one of the areas served by Locooshop. To find out if the desired place for delivery is one of the areas served by Locooshop, please enter the postal code of the desired place for delivery in the area provided for this purpose on the registration page.

No delivery or after-sales service will be performed outside this territory. The present general conditions of sale and the special conditions of sale specific to each of the articles proposed on the site govern the only relations between the company Locooshop sarl E-commerce Maroc and its customers

1. ACCEPTANCE OF CONDITIONS

Any confirmation by the customer of an order entered on the website www.locooshop.com (hereinafter the Site) presupposes on his part the acceptance of the present general conditions of sale Locooshop Sarl, subject to Moroccan law and the acceptance of the special conditions of his order (items ordered as presented on site within the limits of the quantities mentioned). 2.2 Availability of products

3. Username And Password

During the first order, and in order to customize the environment of each client, a user name and password are chosen and entered by the client. A unique identifier check is then performed by the system. The user name and password are proof of the customer’s identity and bind him on any order placed through them.

The customer is solely responsible for his login and password. It shall bear alone the consequences which could result from any use by third parties who have had knowledge of them, unless it demonstrates that the knowledge of its identifier and password results from a fault locooshop .

4. CONTRACT FORMATION: OPERATING MODE AND EVIDENCE

4.1 Saving, Sending Or Withdrawing The Order

An order placed on the site locooshop is not limited on the one hand, by a minimum total amount (cost of goods including VAT, excluding service charges), on the other hand by maximum quantities. Each order entry is simultaneously reviewed before the customer is asked to confirm his order by indicating his choices as to the date, the time range (according to availability), the delivery address and the means of payment. locooshop reserves the possibility of not accepting an order, for a legitimate reason, for example due to a difficulty in supplying a product, a problem concerning the understanding of the order received (document unreadable…), a foreseeable delivery issue (example: delivery requested in a geographical area where there is a proven risk of aggression or verbal or physical threats against our delivery drivers or degradation of our delivery trucks) or due to the abnormality of the order made on our website. In particular, any new order of a customer with whom there is, on the day of the order, an ongoing dispute concerning the payment of a previous order or any order mentioning a delivery address that would prove inconsistent or any order exceeding the usual needs of a consumer and risking making impossible the delivery of our others customers.

If an order cannot be accepted for any of the above reasons, locooshop informs the customer by e-mail. In particular, the customer is asked to regularly consult his mailbox to read any message that could be sent to him by locooshop concerning the invalidity of his order or the impossibility of proceeding with the delivery.

The sales contract is perfect when the order is confirmed when double-clicking. The order is then confirmed to the customer by sending a confirmation email. The transfer of risks to the customer occurs at the time of delivery to the home or when the order is withdrawn if the customer has opted for this method of delivery. The information stated by the customer, when taking the order, commits the customer: in case of error of the customer in the description of his contact details or those of the place of delivery, in particular his last name, first name, address, telephone number, electronic address or credit card or payment number, resulting in the loss of products, the customer remains responsible for the payment of lost products.

4.3 Evidence

6. DELIVERY

6.1. Terms Of Delivery

Delivery is carried out by locooshop delivery agents or service providers in Morocco within the limits of the delivery areas served by locooshop. The place and date of delivery of the goods are chosen by the customer according to the different slots offered when ordering by locooshop. The customer undertakes to take charge of the goods upon their arrival:

AT HIS HOME (according to the address taken by his care during the entry of his order), at the hours and days agreed with locooshop at the time of the order. The customer agrees to provide proof of his identity by means of one or more official documents in force and by communicating the number which has been assigned by the system to his order and which has been communicated to him in the e-mail confirming the order by locooshop. Delivery is made at the door of his domicile.

AT THE HOME OF A THIRD PARTY OF HIS CHOICE at the times and days agreed with locooshop at the time of ordering. In this case, the third party must also agree to provide proof of identity by means of one or more pieces of identification in force and to communicate the number assigned to the order by the system and communicated to the customer in the order confirmation by locooshop. Delivery is made at the door of his domicile.

6.2. Receipt Of The Order

Upon delivery, the customer has the obligation to check the status of the package. In case of non-compliance during delivery, the customer must issue reservations on the delivery note or refuse the goods. During home delivery or in-store pick-up, the customer can check the conformity of the ordered products by unpacking them. Order compliance is defined as the presence of the products, their suitability to the order, and their apparent condition.

The customer also undertakes to sign the payment slip presented by the delivery agent of locooshop or the reception staff of the withdrawal point or to give the third party receiving the goods the power to sign this payment slip on which any comments may be made appearing necessary on the condition of the order or the number of items delivered. The signature of the payment slip and the number of packages received shall indicate the recognition of the delivery.

In the event that the customer finds, after opening the packages, damaged or missing products, it is up to him to contact Customer Service within three (2) hours worked to obtain the exchange or refund of the products subject to the refund of the products at locooshop.

locooshop is unable to deliver, the customer is informed as soon as possible by any means such as email (e-mail) or telephone. locooshop also undertakes in this case to reimburse him the delivery costs as compensation, except in cases of force majeure. Unless locooshop is waived, delivery costs will remain the responsibility of the customer.

6.3. Shipping Cost

7 Terms And Conditions Of Return

The prices invoiced are those in force on the day of the order validation. They appear on the product and service presentation sheets and on the order summary. The prices shown on the product lists and on the “detailed information” sheets do not include delivery costs. The delivery costs are indicated on the site, during the summary of the order, before the customer validates it with the double-click. The total VAT price indicated in the confirmation of receipt of the order is the total price of the order entered, expressed all taxes included and including VAT. The prices visible on the Site are only valid for online purchases

9. THE PROCESSING OF YOUR ORDER

9.1 Information when ordering

The customer is responsible for the completeness and compliance of the information (delivery address, withdrawal point, bank details, delivery constraints…) validated during the order.

11. GUARANTEE CREDIT CARD PAYMENT

In this case, the delivery of the transaction for debit of your account is carried out within one day (subject to availability of products from our suppliers) following the date of the delivery confirmation.

14 Control Management

The information of the personal data collected for the purpose of remote sales is obligatory for the confirmation and validation of the customer’s order as well as its tracking and its shipment; in their absence, the customer’s order cannot be processed: these mandatory data are identified by an asterisk on the form that is filled out when ordering, the others are optional. These data may be transmitted to locooshop providers:

for the sole purpose of the correct execution of the order and in particular of its delivery, according to the options selected by the customer at the time of the order (ex: place of withdrawal); if necessary, they may be checked at the time of delivery;

15 FIGHT AGAINST FRAUD

locooshop reserves the possibility of not following up on a customer’s order for which problems (fraud or unpaid) have already occurred. locooshop in any case retains the ownership of the delivered items until the customer has paid the full price. The events of force majeure as defined by the Moroccan legislation and jurisprudence which make it absolutely impossible to perform the contract of sale by locooshop under the conditions laid down constitute a cause of suspension or extinction of the obligations of locooshop.com sarl, if the event extends beyond a period of 1 month. Locooshop.com cannot then be held liable for the non-performance of the contract concluded in the event of the occurrence of any of the events mentioned above.

18. MODIFICATION

locooshop reserves the right to adapt or modify these general terms and conditions at any time. Thank you for consulting them regularly. The applicable general terms and conditions of sale are those in effect on the day of your order. With each new order, locooshop invites the customer to carefully reread the current general conditions of sale.

19. INTEGRALITE

The nullity of one of the clauses of the present in application of a law, a regulation or following a decision of a competent court passed in force of res judicata will not result in the nullity of the other clauses of the general conditions of sale.

20. DISPUTE
